OFFICIAL NEW HAVEN PHOTO DAY RULES - These Rules apply to the New Haven Photo Day photograph submission event at www.newhavenphotoday.com.
1. WHO MAY SUBMIT A PHOTO
New Haven Photo Day is open everyone; amateur and professional photographers, young and old.
2. HOW TO SUBMIT A PHOTO
(a) Each submission consists of a registration form, and up to three photographs. To enter, visit www.newhavenphotoday.com/submitphoto/
(b) Photographs must have been taken in New Haven, CT on June 17, 2017.
(c) The deadline for photo submissions is Monday, June 19, 2017 at 11:59pm. The registration and submission period officially opens on New Haven Photo Day; June 10, 2017. Photographs that are submitted before June 17, 2017 or after June 19, 2017 will not be accepted.
(d) Photographs must be in digital format. Only online submissions will be eligible. No print or film submissions will be accepted for submissions. The photograph need not be taken with a digital camera; scans of negatives, transparencies, or photographic prints are acceptable. All photograph submissions must be 10 megabytes each or smaller, must be in JPEG or JPG format, and should be at least 1,600 pixels wide if a horizontal image or at least 1,600 pixels tall if a vertical image.
(e) The photograph(s), in its entirety, must be a single work of original material taken by the New Haven Photo Day entrant. By entering, entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the photograph.
(f) The photograph must not, in the sole and unfettered discretion of the New Haven Photo Day, contain obscene, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.
(g) Watermarks are unacceptable. Unless New Haven Photo Day receives a non-watermarked version of the submission within twenty-four hours following its request, the submission will be disqualified.
(h) Only three photographs will be accepted per person. If a photographer uploads more than three photos, only the first three uploaded photos will be accepted and included in this project.
2. AGREEMENT TO RULES
By participating in New Haven Photo Day, you agree to be fully unconditionally bound by these Rules. In addition, You agree to accept the decisions of New Haven Photo Day as final and binding as it relates to the content of this Campaign.
3. RIGHTS GRANTED BY YOU
By submitting a photograph, you understand and agree that New Haven Photo Day, anyone acting on behalf of New Haven Photo Day, and New Haven Photo Day licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your submission, name, likeness, image, statements about New Haven Photo Day, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes; without any further compensation, notice, review, or consent.
4. LIMITATION OF LIABILITY
By submitting a photograph, you agree to release and hold harmless New Haven Photo Day and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:
(a) such entrant’s participation in New Haven Photo Day and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof;
(b) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment;
(c) the unavailability or inaccessibility of any transmissions, telephone, or Internet service;
(d) unauthorized human intervention in any part of the submission process;
(e) electronic or human error in the administration of the Promotion or the processing of entries.
New Haven Photo Day is governed by the laws of The State of Connecticut without respect to conflict of law doctrines. As a condition of participating in this event, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with t New Haven Photo Day, shall be resolved individually, without resort to any form of class action, exclusively before a court located in The State of Connecticut. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees. Participant further waives all rights to have damages multiplied or increased.
